§ 2-141. Determination of lowest and best bidder.

Latest version.
  • (a)

The city manager shall have the authority to award a contract to the lowest bidder for the purchase of equipment, materials and supplies as long as the purchase was previously approved by the city council and the purchase price is within the amount budgeted. Only the city council shall have the authority to waive any irregularities in a bid as set forth in section 2-140 or to reject any bid as set forth in section 2-139. All other purchases which exceed the city manager's purchasing authority shall be approved by the city council.

    (b)

In the event the city manager determines that it is not in the city's best interest to award the contract to the lowest bidder, the city council shall determine who is the lowest and best responsible bidder. In determining the lowest and best responsible bidder, in addition to price, there will be considered the following:

    (1)

The ability, capacity and skill of the bidder to perform the contract.

    (2)

Whether the bidder can perform the contract within the time specified, without delay or interference.

    (3)

The character, integrity, reputation, judgment, experience and efficiency of the bidder.

    (4)

The quality of performance of previous contract.

    (5)

The previous and existing compliance by the bidder with laws and ordinances relating to the contract.

    (6)

The sufficiency of the financial resources and ability of the bidder to perform the contract or provide the service.

    (7)

The quality, availability and adaptability of the supplies, or contractual services to the particular use required.

    (8)

The ability of the bidder to provide future maintenance and service for the use of the subject of the contract.

    (9)

The number and scope of conditions attached to the bid.

    (10)

Such other factors as appear to the city council to be pertinent to the bid or the contract under all of the circumstances involved.
