§ 7-6. Garbage and trash storage facilities and enclosures.

  • (a)

    Enclosures; applicable codes; disinfecting. Garbage and trash storage facilities in all zoning districts, except single-family, shall be screened by the owner so as to completely conceal such facilities from the view of the general public and shall not be located on public right-of-way. This screening shall have a height of six (6) feet from the top of the pad or paved surface, if any, and conform generally to the aesthetics and architectural characteristics of the adjoining structure or structures. The community development director may eliminate or partially eliminate the required enclosure, based upon the following criteria: An enclosure shall not be required if:

    (1)

    The storage facilities are surrounded by adjoining structures on the same parcel of land; or

    (2)

    The dumpster is located in the rear yard of the property as defined in Article II Section 200.00 of the South Daytona Zoning Ordinance 89-16, adopted August 22, 1989, and is set back a minimum of one hundred fifty (150) feet from all street right-of-way lines; or

    (3)

    The property is located in an LI light industrial district and the dumpster is located in the rear yards.

    The screened enclosure, when located in the front yard or side yard on a corner lot and when detached from the principal structure, shall be landscaped to create a visual barrier on three (3) sides. The landscaping shall have a height of four (4) feet. The use of low-maintenance, long-life materials shall be required. All applicable fire, life safety and building codes shall be met. In addition, all dumpsters shall be disinfected at least one (1) time each week.

    (b)

    Storage facility specifications. The doors and openings of each storage facility shall be closed except during loading and unloading. Failure to keep the storage facility doors and openings closed as prescribed shall constitute a violation of this section. Each storage facility shall have a twelve-foot-wide paved access. The storage facility and enclosure as a combined unit shall be placed directly adjacent to the lane of travel to be used by the collection vehicle. For dumpster collection, the angle of the facility with the land shall allow for a straight-line maneuvering distance of fifty-five (55) feet from the front of the screening. It shall be unlawful to access the storage facility over a yard area without a paved access.

    (c)

    Gates. Each enclosure shall contain gates, except as otherwise authorized, of a like or compatible material. The gates for dumpster collection enclosures shall have a minimum width of dumpster plus four (4) feet and ninety (90) degrees of swing with a gate-stop mechanism on each gate. The gates shall be closed except during the loading and unloading of the storage facilities. Failure to keep the gates closed as prescribed shall constitute a violation of this section.

    (d)

    Responsibility of owner. It shall be the responsibility of the owner and business operator to maintain the facilities in good order and in accordance with this chapter at all times.

    (e)

    Building permit required. A building permit will be required for construction of a storage facility enclosure in accordance with chapter 5 of the city Code.

    (f)

    Container size; frequency of pickup. The container size of each individual storage facility and the frequency of pickup shall be approved and regulated by the city.
