§ 5-304. Statement of purpose.

  • (a)

    The provision of adequate recreational space and facilities is an integral part of the city's plan for enhancing the health and general welfare of its citizens. The city council desires to fund recreational facilities necessitated by new growth through the accepted practice of impact fees on new development. The city council, in conjunction with the land development regulation board and the recreation advisory board, have carefully considered the future recreational needs of the city.

    (b)

    The purpose of this section is to establish a recreational development impact fee to be paid for each residential dwelling unit to be constructed in the city subsequent to the adoption of this section (new development). This fee is charged to cover the proportionate cost of the acquisition and development of land and construction of new facilities necessary to meet the need for city parkland and recreation areas created by new development in order to provide a city recreation system which will be available to and substantially benefit the residents of such new development.
