§ 5-300. Intent.

  • The purpose and intent of these regulations are to fairly and reasonably allocate the total motorized boat slips (boat slips) allotted to the City of South Daytona (city) pursuant to the Volusia County Manatee Protection Plan (plan) so as to assure that adequate numbers of boat slips are available for public use, private residential multi-family docks, and single-family residences along the Halifax River. Furthermore, the city shall designate the public projects that will provide the net positive public benefit for private residential multi-family docks that preempt more than forty (40) square feet of sovereign submerged lands for each one (1) linear foot of common riparian shoreline along sovereign submerged land of the Halifax River (i.e. "the 40:1 rule").
