§ 2-403. Rights and benefits.

  • (a)

    Nonbargaining unit personnel shall have all the rights as set forth in the city's policies and procedures manual, revised, or future amendments thereto and to the extent that policies and procedures are not in conflict with this article.

    (b)

    Nonbargaining unit personnel shall be granted at least the same level of benefits regarding leave with pay, insurance, Florida Retirement System Pension, holidays and other employee benefit programs as set forth in the policies and procedures manual as provided to other employees and as approved in the budget.

    (c)

    Nonbargaining unit personnel shall not be eligible for overtime compensation or compensatory time. The city manager is hereby authorized to grant administrative leave without pay occasionally during each fiscal year, which will not be chargeable as leave with pay. This will be granted in consideration of the extra time department heads may be required to spend in the course of their duties.

    (d)

    Personal leave accrual can accumulate up to a maximum of nine hundred sixty (960) hours with pay off at termination or retirement.

    (e)

    Additionally, provided nonbargaining unit personnel maintain a minimum of three hundred sixty (360) hours of personal leave they will be exempted from the requirement to use fifty (50) percent of the personal leave annual accrual in order to participate in the personal leave payoff policy.

    (f)

    Nonbargaining unit personnel that are either department heads or assistance department heads will be classified as senior management under the Florida Retirement System, as long as the position meets all requirements under state law and that the city has an available position to designate as senior management. In the event there are more department heads than positions available to be designated to be designated as senior management, the department head with the most years of service with the city will receive the senior management designation. When a department head is designated as a senior manager, the city may purchase, at the city manager's discretion and at the city's cost, all of the employee's past service credit.
